1. Agreement to Terms

By accessing or using Flinker ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you disagree with any part of these terms, you may not access or use the App.

2. Description of Service

Flinker is a genealogical tree application that allows users to:

• Create and manage one or more family trees
• Add and organize family member information (including optional photos, dates, locations, education, career, and custom fields)
• Visualize family relationships and timelines
• View family statistics and insights
• Collaborate on shared trees ("spaces") with roles such as owner, contributor, or viewer
• Invite others via shareable links or codes, subject to the permissions you grant
• Receive optional push notifications (e.g. birthday-related reminders) if enabled on your device
• Sign in with email and password, Google, or Apple (where available on your platform)

Features may change over time; we may add, modify, or remove functionality. The App is offered as described at the time of use unless we notify you otherwise.

3. User Accounts

3.1 Account Creation

To use Flinker, you must create or connect an account using one of the supported methods:

• Email address and a secure password, or
• Sign in with Google, or
• Sign in with Apple (where available)

You must provide accurate information and keep your contact details up to date where the App requires them. You are responsible for maintaining the confidentiality of your account credentials and for any activity under your account, except where caused by our gross negligence or unauthorized access we failed to reasonably prevent.

3.2 Account Responsibility

You are responsible for:

• All activities that occur under your account
• Maintaining the security of your account
• Notifying us immediately of any unauthorized use
• Ensuring that all information you provide is accurate and up-to-date

4. Acceptable Use

4.1 Permitted Use

You may use Flinker only for lawful purposes and in accordance with these Terms. You agree to:

• Use the App for personal or family genealogical purposes
• Provide accurate and truthful information to the best of your knowledge
• Respect the privacy of family members and other individuals whose information you add
• Obtain any required consent before adding or sharing sensitive information about living individuals
• Use collaborative features responsibly: only invite people you intend to include, and do not misrepresent your role or misuse invites

4.2 Prohibited Use

You agree NOT to:

• Use the App for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Infringe upon the rights of others
• Upload malicious code, viruses, or harmful content
• Attempt to gain unauthorized access to other users' accounts or data
• Use automated systems to access the App without permission
• Impersonate any person or entity
• Harass, abuse, or harm other users

5. User Content and Data

5.1 Ownership

You retain ownership of all family tree data and information you create or upload to Flinker ("User Content").

5.2 License to Use

By using Flinker, you grant us a limited, non-exclusive, worldwide license to:

• Store, process, and display your User Content to provide the service (including to other members of spaces you join or create)
• Host and transmit files (e.g. profile photos) on our infrastructure
• Create backups of your data
• Generate statistics and insights from your data
• Run automated processing needed for features you use (e.g. indexing or notification-related processing)

This license terminates when you delete your account or remove specific content, except where retention is required by law or where content remains in a shared space under another member's control until removed or the space is deleted.

5.3 Content Responsibility

You are solely responsible for:

• The accuracy and legality of all User Content
• Obtaining necessary permissions to add information about family members
• Respecting privacy rights of individuals whose information you add
• Complying with applicable data protection laws

6. Sharing, Collaboration, and Privacy

Flinker allows you to share and collaborate on family trees. When you create a space, invite others, or accept an invite:

• Members may see tree data according to their role (e.g. viewer vs contributor)
• You are responsible for ensuring you have the right to add, edit, or share information about living people
• Invite links may allow others to join; treat links as confidential unless you intend them to be public
• We are not liable for disputes between you and other members regarding accuracy, consent, or use of shared information
• Our Privacy Policy describes how personal data is processed; these Terms govern your conduct and our service rules

6.1 Push notifications

Optional push notifications may be available (e.g. reminders). You can enable or disable them in your device settings. Message frequency and content depend on your trees and app settings.

7. Intellectual Property

7.1 Our Rights

The Flinker app, including its design, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws.

7.2 Your Rights

You retain all rights to your User Content. We do not claim ownership of your family tree data.

8. Service Availability

We strive to provide reliable service but do not guarantee that:

• The App will be available at all times
• The App will be error-free or uninterrupted
• Any defects will be corrected

We reserve the right to modify, suspend, or discontinue the App at any time with or without notice.

9. Limitation of Liability

To the maximum extent permitted by law:

• Flinker is provided "as is" and "as available"
• We disclaim all warranties, express or implied
• We are not liable for any indirect, incidental, special, or consequential damages
• We are not responsible for loss of data, though we maintain backups
• Our total liability is limited to the amount you paid for the service (if any)

10. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Your User Content

11. Termination

11.1 By You

You may terminate your account at any time by deleting it through the App settings. Upon termination, your data will be deleted in accordance with our Privacy Policy.

11.2 By Us

We may terminate or suspend your account immediately, without prior notice, if you:

• Violate these Terms
• Engage in fraudulent or illegal activity
• Fail to pay any fees (if applicable)
• For any other reason we deem necessary

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms on this page
• Updating the "Last Updated" date
• Notifying you through the App (if significant changes occur)

Your continued use of the App after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions.

14. Dispute Resolution

Any disputes arising from these Terms or your use of Flinker shall be resolved through:

• Good faith negotiation
• If negotiation fails, through binding arbitration or the courts of France

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the use of Flinker and supersede all prior agreements and understandings.
